By accessing or using Postigniter ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

Postigniter provides AI-powered tools for social media content creation and optimization, including but not limited to:

• Video title generation
• Keyword and tag generation
• Description generation
• Channel name suggestions
• Channel analytics and insights
• Other content optimization tools

3. User Accounts

3.1 Registration

Some features require account registration. When registering, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Generate spam, misleading, or deceptive content
• Create content that is harmful, abusive, or hateful
• Attempt to circumvent usage limits or security measures
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service excessively
• Resell or redistribute the Service without authorization
• Impersonate others or misrepresent your affiliation

5. Content Ownership

5.1 Your Content

Content you generate using our tools belongs to you. You retain all rights to the titles, descriptions, keywords, and other content created through our Service. You are responsible for how you use this content.

5.2 Our Content

The Service, including its design, features, code, and documentation, is owned by Postigniter and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

6. Usage Limits

To ensure fair access for all users, we implement usage limits:

• Guest Users: Limited daily generations without an account
• Free Registered Users: Increased daily generation limits
• Pro Users: Higher or unlimited generation limits (when available)

We reserve the right to modify these limits at any time. Attempting to circumvent usage limits may result in account suspension.

7. Promotional and Founder Pricing

From time to time we offer promotional or "founder" pricing on a specific plan and billing interval, sometimes limited to a fixed number of subscribers. Where you have claimed such an offer, the following terms apply in addition to the rest of these Terms:

• Scope: The promotional rate applies only to the specific plan and billing interval on which it was purchased. It is not a discount on your account generally.
• Duration: The rate continues to apply at each renewal for as long as your subscription to that plan and interval remains continuously active.
• Forfeiture on change: Changing your plan — including upgrading, downgrading, or switching between monthly and annual billing — permanently ends the promotional rate. Your new plan is billed at the standard rate then in effect, and the promotional rate cannot be reinstated.
• Forfeiture on cancellation: If your subscription is cancelled or lapses for non-payment, the promotional rate ends. Subscribing again later is at the standard rate then in effect, even if the original offer has not been withdrawn.
• Limited availability: Promotional offers may be limited to a stated number of subscribers and are available on a first-come, first-served basis until that limit is reached.
• Withdrawal: We may modify or withdraw any promotional offer at any time and without notice. Doing so does not affect the rate of subscribers who claimed the offer before it was withdrawn, whose pricing continues under the terms above.
• Eligibility: Promotional codes are for use by the intended recipient and may not be resold or transferred. We may reverse a discount and charge the standard rate where an offer has been obtained through misuse or misrepresentation.
• Billed on purchase: Promotional pricing is charged at the time of purchase rather than after a free trial. Where a promotion is limited to a fixed number of subscribers, your place is reserved when payment completes, not when checkout is started.
• Refunds: Your initial promotional purchase is covered by our 30-day money-back guarantee: contact us within 30 days of that purchase for a full refund. Subsequent renewals of a promotional subscription are not refundable; cancel before a renewal date to avoid being charged for the coming term.

Taxes, where applicable, are calculated on the discounted amount actually charged. Promotional pricing does not change any usage limit or feature entitlement of the underlying plan.

8. Third-Party Services

Our Service may integrate with third-party services such as YouTube. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or content of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The Service will be uninterrupted or error-free
• Generated content will achieve any specific results
• The Service will meet your specific requirements
• Any defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTIGNITER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Postigniter and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination (such as ownership, disclaimers, and limitations of liability) will remain in effect.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Postigniter operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
